Terms of Service

These Terms govern your use of Heatmaps Pro (the "Service"), operated by Volkan Kezer, a sole proprietor established in Türkiye ("we", "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What the Service is

Heatmaps Pro is a market data visualization tool. It displays publicly available derivatives market data from Binance Futures — price changes, trading volume, funding rates, open interest, and order book depth — and applies computed indicators to that data.

The Service is informational software. It does not execute trades, hold funds, connect to your exchange account, or manage positions on your behalf.

2. Not financial advice

This is the most important term in this document. Read it carefully.

Nothing the Service displays is investment advice, a recommendation, a solicitation, or an offer to buy or sell any financial instrument. This includes — without limitation — any indicator, score, signal, label, badge, colour, ranking, or text such as "LONG", "SHORT", "strength", "entry ready", or "watch".

These are the visual output of arithmetic applied to public market data. They are not predictions, and they carry no assurance of accuracy, profitability, or suitability for you.

You acknowledge that:

• Trading cryptocurrency derivatives carries a high risk of loss, including total loss of deposited funds, and losses may exceed your initial deposit when leverage is used.
• Every trading decision you make is yours alone, made at your own risk.
• We are not your broker, financial advisor, fiduciary, or portfolio manager, and no such relationship is created by your use of the Service.
• You are solely responsible for determining whether any trading activity is appropriate for your circumstances, and for complying with the laws and regulations that apply to you.

If you need financial advice, consult a licensed professional in your jurisdiction.

3. Data accuracy and availability

Market data originates from third-party sources, principally Binance. We do not control, verify, or guarantee that data.

Data may be delayed, incomplete, interrupted, stale, or wrong. Connections may fail. Indicators computed from imperfect data will themselves be imperfect. The Service displays status indicators when it detects degraded or stale data, but these indicators are themselves best-effort and may not catch every failure.

The Service is provided on an "as is" and "as available" basis. We do not warrant uninterrupted or error-free operation, and we may modify, suspend, or discontinue any part of it at any time.

4. Accounts

You must be at least 18 years old and legally capable of entering into contracts to use the Service.

You are responsible for the accuracy of your registration information, for maintaining the security of your credentials, and for all activity under your account. Notify us promptly at support@heatmaps.pro if you suspect unauthorized access.

We may suspend or terminate accounts that violate these Terms.

5. Plans and entitlements

The Service offers Free, Pro, and Premium tiers. Each tier defines the number of symbols tracked and the features available. Current tier details are published at heatmaps.pro/pricing.

Tier limits described on the pricing page are catalog capabilities. Actual coverage depends on the symbols available on the underlying exchange at any given time, which changes as instruments are listed and delisted.

We may change tier contents, limits, and prices. For paid subscriptions, we will give reasonable advance notice of price changes, and changes take effect at your next renewal. Continuing to use a paid plan after a price change takes effect constitutes acceptance.

6. Payment

Paid subscriptions are sold and processed by Paddle.com Market Ltd ("Paddle"), which acts as the Merchant of Record for these transactions. Paddle handles payment processing, invoicing, and applicable sales tax and VAT.

Your purchase is therefore subject to Paddle's own terms and privacy policy in addition to these Terms. We never receive or store your full payment card details.

Subscriptions renew automatically for successive billing periods until cancelled. You may cancel at any time; cancellation takes effect at the end of the current paid period, and access continues until then.

Refunds are governed by our Refund Policy.

7. Acceptable use

You may not:

• Resell, redistribute, sublicense, or commercially exploit the Service or its data output without our written permission.
• Scrape, mine, or systematically extract data from the Service by automated means.
• Circumvent, disable, or attempt to bypass tier limits, authentication, rate limits, or any other technical restriction.
• Reverse engineer, decompile, or attempt to derive the source code of the Service, except where such restriction is prohibited by law.
• Interfere with the Service's operation, probe its infrastructure, or place unreasonable load on it.
• Use the Service in violation of any applicable law, including sanctions and market abuse regulations.

8. Intellectual property

The Service — including its software, interface, design, and computed indicators — is our property or that of our licensors, protected by intellectual property law. These Terms grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your own purposes, and nothing more.

Underlying market data remains the property of its respective sources.

9. Limitation of liability

To the maximum extent permitted by law:

• We are not liable for any trading losses, lost profits, lost opportunities, lost data, or any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service.
• Our total aggregate liability for any claim relating to the Service is limited to the amount you paid us in the twelve months preceding the event giving rise to the claim.
• We are not liable for failures, inaccuracies, or interruptions caused by third parties, including exchanges, data providers, payment processors, and hosting or network providers.

Nothing in these Terms excludes liability that cannot lawfully be excluded, including liability for fraud, or for death or personal injury caused by negligence. If you are a consumer, these limits do not affect your mandatory statutory rights.

10. Indemnity

You agree to indemnify and hold us harmless from claims, damages, and expenses (including reasonable legal fees) arising from your use of the Service, your breach of these Terms, or your violation of any law or third-party right.

11. Termination

You may stop using the Service at any time. To have your account deleted, email support@heatmaps.pro; deletion is handled as described in our Privacy Policy. Deleting your account does not by itself cancel a paid subscription — cancel that separately, as described in Section 6.

We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Service. On termination, your licence ends immediately. Sections 2, 3, 8, 9, 10, and 12 survive termination.

12. Governing law and disputes

These Terms are governed by the laws of the Republic of Türkiye, and the courts of İzmir, Türkiye have jurisdiction over any dispute.

If you are a consumer resident in the European Union, the United Kingdom, or another jurisdiction whose law grants you the right to bring proceedings in your local courts and to the protection of your local mandatory consumer law, that right is unaffected by this section.

13. Changes to these Terms

We may update these Terms. Material changes will be announced through the Service or by email at least 14 days before taking effect. The "Last updated" date above always reflects the current version. Continuing to use the Service after changes take effect constitutes acceptance.
